Jonathan Massey and Matthew Collette file brief in Supreme Court on behalf of bankruptcy experts addressing the Bankruptcy Code’s “party in interest” rule

Massey & Gail’s amicus curiae brief urges the Supreme Court to hold that insurers with no economic stake in the case are not “parties in interest” entitled to challenge a bankruptcy settlement. The brief contends that granting party-in-interest status to the insurer in the “insurance neutral” bankruptcy settlement would disserve the bankruptcy system and delay bankruptcy settlements. Massey & Gail settles eight-figure international products liability action

On behalf of one of Mexico’s largest publicly traded companies, M&G recently settled a four-party products liability action following a commercial building fire in 2018. The plaintiff sought eight figures in damages. This settlement followed over three years of extensive international discovery, including depositions conducted with witnesses on three continents. Though Suyash Agrawal led the team, the associates managed the case on a day-to-day basis alongside. The firm’s associates took and defended over 15 depositions in this action.

Third Circuit dismisses J&J “Texas” two-step” bankruptcy

In an appeal handled by Massey & Gail and others representing the creditors’ committee representing tens of thousands of talc claimants, the Third Circuit dismisses Johnson & Johnson’s “Texas two-step” bankruptcy as filed in “bad faith.” Read more about the case here.
