Rob Park represents companies and trade associations in complex litigation, government investigations, and regulatory disputes, with a particular focus on healthcare and other matters involving overlapping legal, business, and reputational risks. Drawing on senior roles in government and a Fortune 10 company, Rob helps clients frame complicated problems clearly, make sound decisions under pressure, and develop strategies aligned with their broader business objectives.
Before rejoining Massey & Gail, Rob spent eight years at McKesson Corporation, where he led the company’s litigation and investigations and oversaw key healthcare regulatory matters. At McKesson, he directed the company’s defense of the opioid litigation from its earliest days through resolution, selecting cases for trial, developing the legal theories that shaped the defense, and overseeing four trials. He also helped negotiate settlements with all 50 state attorneys general and thousands of municipalities nationwide, advised the company’s board and senior leadership, and prepared its chief executive officer for congressional testimony. At the same time, Rob directed an affirmative-claims portfolio that recovered more than $1 billion in antitrust and insurance matters.
Rob’s healthcare experience includes constitutional challenges to state healthcare laws, False Claims Act matters, government price reporting, the Anti-Kickback Statute, Stark Law, FDA and CMS regulation, and other issues affecting the pharmaceutical supply chain. He understands how executives and boards evaluate litigation—not as an abstract legal exercise, but as a business problem with financial, operational, and reputational consequences. Clients benefit from his ability to integrate litigation, regulatory strategy, government relations, and practical business judgment.
Earlier in his career, Rob held senior positions at the Department of Defense. As Acting General Counsel of the Army, he served as chief legal officer of a $100 billion organization with 1.3 million soldiers and civilians and advised the Secretary of the Army on sensitive operational, procurement, personnel, and congressional matters. As Acting Deputy General Counsel of the Department of Defense, he oversaw the Department’s litigation, including matters involving military operations, national security, and detainee policy.
Rob previously practiced at Williams & Connolly and Massey & Gail. He clerked for Judge Steven M. Colloton of the U.S. Court of Appeals for the Eighth Circuit. He graduated with high honors and Order of the Coif from the University of Chicago Law School and earned his undergraduate degree in mathematics and history, with honors and Phi Beta Kappa, from Grinnell College.
Representative Matters
Opioid Litigation
- Represented McKesson in more than 3,000 opioid cases brought by state attorneys general, municipalities, and private plaintiffs, including national litigation strategy, trials, appeals, and settlement negotiations.
- Represented McKesson in trial and appellate proceedings involving opioid claims brought by West Virginia municipalities and the City of Baltimore.
- Represented McKesson in jury trial of claims under Georgia’s Drug Dealer Liability Act and state RICO law; obtained defense verdict on all claims, affirmed by the Supreme Court of Georgia.
- Represented McKesson in the Washington Attorney General’s opioid action through trial and settlement.
Constitutional and Administrative Litigation
- With colleagues from Massey & Gail, represented McKesson in a constitutional challenge to New York’s Opioid Stewardship Act; the Appellate Division reversed the trial court’s dismissal of the challenge.
- Represented McKesson in constitutional litigation challenging Connecticut’s pharmaceutical price controls under the Dormant Commerce Clause.
- Represented McKesson in Telephone Consumer Protection Act class action litigation that reached the U.S. Supreme Court as McLaughlin Chiropractic Associates, Inc. v. McKesson Corp., addressing the Hobbs Act and judicial review of Federal Communications Commission interpretations.
False Claims Act Matters
- Represented McKesson in United States ex rel. Hart v. McKesson Corp., involving alleged kickbacks through services provided to oncology practices; obtained dismissal of the federal False Claims Act claim, affirmed by the Second Circuit, with remand of state claims.
- Represented McKesson in United States ex rel. CIMZNHCA, LLC v. UCB, Inc., involving patient support services and the government’s authority to dismiss qui tam actions; the Seventh Circuit reversed and directed dismissal.
Congressional and Administrative Matters
- Prepared McKesson’s CEO for testimony before the House Energy and Commerce Committee concerning opioid distribution and diversion.
- Prepared senior executive for testimony before the House Ways and Means Committee concerning chronic drug shortages.
- As a senior lawyer at the Department of Defense, prepared senior officials for testimony before Armed Services, Appropriations, and Intelligence committees.
- Represented McKesson in multiple comment letters responding to proposed CMS and HHS regulations governing drug pricing.
Antitrust and Other Commercial Litigation
- Represented McKesson Medical-Surgical in Marion Diagnostic Center, LLC v. Becton Dickinson & Co., a putative antitrust class action involving the distribution of syringes and catheters; obtained dismissal, affirmed by the Seventh Circuit.
- Represented McKesson in affirmative antitrust litigation challenging pay-for-delay agreements and alleged generic drug price fixing.
- Represented McKesson in shareholder derivative and securities litigation, including matters arising from opioid distribution and allegations of generic drug price fixing.
- Represented McKesson in insurance coverage disputes arising from the nationwide opioid litigation.
