Massey & Gail Wins Summary Judgement for UNITE HERE Health in ERISA Class Action

Massey & Gail LLP secured a complete summary judgment victory in an ERISA class action challenging administrative expenses in a multiemployer health plan. Plaintiffs alleged that the plan’s trustees breached fiduciary duties by incurring excessive expenses and improperly allocating those expenses among plan units. The court rejected those claims in full, finding no actionable harm. The case raised novel issues regarding how administrative expenses are allocated within a single multiemployer plan. The Massey & Gail team included Leonard Gail, Matthew Collette, Kylie Chiseul Kim, Peter Stasiewicz, and Brigid Carmichael. Leonard Gail told Law360 that the decision “vindicates UHH’s longstanding position that plaintiffs’ claims were unsupported by the evidence.” Read Law360 coverage here.

Jonathan Massey and Bret Vallacher Defeat Motion to Dismiss in Challenge to Delaware’s Unclaimed Property System

Massey & Gail partners Jonathan Massey and Bret Vallacher, with support from the firm’s litigation team, recently defeated Delaware’s motion to dismiss in a federal constitutional challenge to the State’s unclaimed property scheme. By overcoming sovereign immunity defenses, the decision allows claims seeking recovery of millions in securities to proceed and puts Delaware’s escheat practices squarely at issue. Read more here.

Massey & Gail Seeks Preliminary Injunction in Connecticut Drug Pricing Case

Massey & Gail partner Jonathan Massey recently argued for a preliminary injunction against a Connecticut drug price cap law on behalf of pharmaceutical distributors. Jonathan Massey explained that distributors do not set prices and that the law violates the Commerce Clause and imperils patient access to important medicines. Concurrences Publishes Jonathan Massey’s Analysis of Antitrust and Online Content Moderation

We are proud to share that Founding Partner Jonathan Massey has authored “Antitrust, Content Moderation, and the First Amendment,” in the November 2025 issue of Concurrences, an international competition law journal. Jonathan’s article examines the constitutional boundaries of antitrust regulation as applied to online content moderation by social media platforms. His contribution appears as part of a symposium of leading scholars and practitioners addressing the evolving relationship between antitrust law, platform governance, and free expression.

Massey & Gail Secures Justice for Incarcerated Client in Stateville Case

Massey & Gail LLP is proud to have represented, pro bono, an incarcerated individual in his lawsuit challenging the conditions of his confinement at the thankfully now-closed Stateville Correctional Center in Joliet, Illinois. Partner Constance Grieves and Associate Brigid Carmichael undertook the representation as part of the Northern District of Illinois’ Settlement Assistance Program for pro se plaintiffs. After completing discovery and defeating the defendants’ motion for summary judgment, they secured a $15,000 settlement for their client. We fight hard for our pro-bono clients and are honored to give them the zealous representation they deserve.
